By accessing and using the services provided by Comsys Web Design & Hosting ("Comsys," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Comsys provides:

  • Shared web hosting services
  • Web design and development services
  • Domain registration services
  • Email hosting services
  • Technical support

3. Account Registration

To use our services, you must:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Payment and Billing

4.1 Fees

You agree to pay all fees associated with your selected services. Fees are charged in South African Rand (ZAR) and are subject to change with 30 days notice.

4.2 Billing Cycle

Services are billed monthly or annually, as selected during registration. Payments are due on the billing date.

4.3 Late Payments

Accounts with overdue payments may be suspended or terminated. A late fee may apply to overdue accounts.

4.4 Refunds

We offer a 30-day money-back guarantee for new hosting accounts. Refunds are not available for domain registrations, setup fees, or services used beyond 30 days.

5. Acceptable Use Policy

You agree not to use our services for:

  • Illegal activities or content
  • Spam or unsolicited bulk email
  • Malware, viruses, or harmful code
  • Phishing or fraudulent activities
  • Copyright or trademark infringement
  • Adult content or illegal material
  • Excessive resource usage that affects other users
  • Mining cryptocurrency
  • Proxy or VPN services
  • File sharing or torrent hosting

6. Resource Usage and Fair Usage

Shared hosting accounts are subject to fair usage policies. Excessive resource usage may result in:

  • Temporary suspension
  • Request to upgrade to a higher plan
  • Account termination for repeated violations

7. Uptime and Service Level

We strive to maintain 99.9% uptime for our hosting services. However, we do not guarantee uninterrupted service and are not liable for:

  • Scheduled maintenance
  • Emergency maintenance
  • Force majeure events
  • Third-party service failures
  • DDoS attacks or security incidents

8. Data Backup

While we perform regular backups, you are responsible for maintaining your own backups. We are not liable for data loss.

9. Content Ownership

You retain all rights to content you upload to our servers. By using our services, you grant us the right to store, display, and transmit your content as necessary to provide our services.

10. Web Design Services

10.1 Project Scope

Web design projects are defined by a written agreement or proposal. Changes to the scope may incur additional fees.

10.2 Client Responsibilities

Clients must provide:

  • Timely feedback and approvals
  • Content, images, and materials
  • Access to necessary accounts and systems

10.3 Intellectual Property

Upon full payment, you own the final website design. We retain the right to display the work in our portfolio.

11. Termination

11.1 By You

You may cancel your services at any time. Cancellations take effect at the end of the current billing period. No refunds for partial months.

11.2 By Us

We may suspend or terminate your account for:

  • Violation of these Terms of Service
  • Non-payment
  • Fraudulent activity
  • Excessive resource usage
  • Illegal content or activities

12. Limitation of Liability

To the maximum extent permitted by law, Comsys shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Third-party actions or content

Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Comsys harmless from any claims, damages, or expenses arising from:

  • Your use of our services
  • Your content or activities
  • Violation of these terms
  • Violation of any laws or third-party rights

14. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or website notice. Continued use of our services constitutes acceptance of the modified terms.

15. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.

16. Privacy

Your use of our services is also governed by our Privacy Policy.

17. Support

We provide technical support via email, phone, and WhatsApp during business hours. Emergency support is available 24/7 for critical hosting issues.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy and Fair Usage Policy, constitute the entire agreement between you and Comsys.
